 A red flare means the plane have been hit bad and the pilot is pulling from the fight, any pilot with honor would let the poor guy fly home to base and get a new plane. No need to kill the pilot.

 If the pilot been hit or his engine is dead he dont have a chance to fight back and then he pulls from the fight.. any person with honor would accept that.
